BimmerControl est un outil de diagnostic qui LIT et, sur abonnement, ÉCRIT dans les calculateurs de votre véhicule. Ces conditions disent qui fait quoi, et qui répond de quoi.
1. Objet et acceptation
Ces conditions régissent l'utilisation de l'application BimmerControl et des services associés. En installant ou en utilisant l'application, vous les acceptez. Si vous ne les acceptez pas, n'utilisez pas l'application.
2. Ce que fait l'application
BimmerControl se connecte à la prise de diagnostic de votre véhicule par un adaptateur, lit l'état des calculateurs et, selon votre formule, exécute des commandes que le véhicule prévoit lui-même.
L'application est destinée à un usage personnel sur un véhicule dont vous êtes propriétaire, ou sur lequel le propriétaire vous a autorisé à intervenir.
Il vous revient de vérifier que votre véhicule et votre adaptateur sont compatibles, et que ce que vous faites est licite là où vous êtes.
3. Sécurité — à lire avant la première utilisation
Vous êtes seul responsable de l'usage que vous faites de l'application, des commandes que vous lancez et de leurs conséquences.
- N'utilisez jamais l'application en conduisant. Le véhicule doit être à l'arrêt.
- Certaines fonctions mettent des organes en mouvement : phares, essuie-glaces, ventilateurs, étriers de frein, direction. Assurez-vous que personne ne se trouve à proximité du véhicule et qu'aucune main n'est engagée dans une roue, sous le capot ou dans une ouverture.
- Le mode maintenance des freins rend le frein de stationnement inopérant. Calez les roues, restez sur un sol plat, ne déplacez pas le véhicule tant que le mode est actif.
- N'utilisez aucune fonction d'éclairage — commande de phare, séquence lumineuse, jeu de lumière, essai de sortie — sur un véhicule en mouvement ni sur la voie publique. Ces fonctions sont destinées à un véhicule à l'arrêt, hors circulation. Éblouir, faire clignoter des feux ou reproduire une signalisation de véhicule prioritaire expose à des sanctions pénales et peut provoquer un accident.
- Respectez les règles de circulation et la réglementation applicable à l'éclairage de votre pays. Une configuration lumineuse autorisée quelque part peut être interdite ailleurs, et l'application ne vérifie pas la conformité de ce que vous réglez.
- Une tension de batterie insuffisante pendant une écriture peut endommager un calculateur. N'intervenez pas sur une batterie faible.
4. Écriture dans les calculateurs
Les fonctions d'écriture — activations, adaptations, réinitialisations, réglages d'éclairage, modes de maintenance — modifient réellement le comportement du véhicule.
Elles ne sont proposées que lorsque le véhicule les déclare lui-même, et l'application demande une confirmation avant chaque écriture. Elle ne peut pas pour autant garantir qu'une commande soit adaptée à votre véhicule dans son état du moment.
Certaines opérations sont irréversibles : la remise à zéro de valeurs d'adaptation, par exemple, efface un apprentissage que le calculateur devra refaire en roulant.
Une intervention par diagnostic peut être relevée par un réseau constructeur et, selon les cas, affecter une garantie ou un contrat de service. Vérifiez ce point avant d'écrire sur un véhicule sous garantie.
Vous assumez ce risque. Nous ne prenons en charge ni réparation, ni reprogrammation, ni immobilisation consécutive à une écriture.
5. Aucun lien avec BMW
BimmerControl est une application indépendante. Elle n'est ni affiliée à BMW AG ou à l'une de ses filiales, ni approuvée, ni parrainée, ni soutenue par elles.
« BMW », le logo BMW et les désignations de modèles sont des marques déposées de BMW AG, citées ici uniquement pour indiquer la compatibilité des véhicules.
6. Compte
Un compte est nécessaire. Il s'ouvre avec Google ou Apple, et vous êtes responsable de l'accès à celui-ci.
Un compte est personnel. Le partager, le revendre ou le mutualiser n'est pas autorisé.
Les informations que vous fournissez doivent être exactes.
7. Essai, formules et abonnements
Les prix, les durées et les conditions de l'essai sont affichés dans l'application avant tout paiement.
Les abonnements sont gérés par votre compte Google Play (ou Apple sur iOS) et se renouvellent automatiquement, sauf résiliation au moins 24 heures avant la fin de la période en cours. La résiliation se fait dans les réglages d'abonnement de votre compte Google ou Apple, pas dans l'application.
À l'échéance d'un abonnement, les fonctions d'écriture cessent d'être disponibles. Les données déjà enregistrées sur votre téléphone restent les vôtres et restent lisibles.

8. Remboursements
Tous les paiements sont encaissés par Google Play ou par Apple. Nous ne recevons pas votre argent directement et ne pouvons donc pas rembourser nous-mêmes : toute demande suit la politique de remboursement de la boutique concernée.
Si vous résidez dans l'Union européenne, votre droit de rétractation légal sur les contenus numériques s'applique selon les modalités de la boutique.
9. Propriété intellectuelle
L'application, son code, son interface, ses textes et ses éléments graphiques appartiennent à BimmerControl et sont protégés.
Vous recevez un droit d'usage personnel, non exclusif et non transférable. Vous ne pouvez pas copier, distribuer, louer, vendre, modifier, décompiler ni faire de l'ingénierie inverse sur tout ou partie de l'application, sauf dans la mesure où la loi l'autorise malgré cette interdiction.
Les données de diagnostic propres à votre véhicule vous appartiennent.
10. Ce que vous vous engagez à ne pas faire
L'application relève et affiche les kilométrages mémorisés par les différents calculateurs. Cette fonction existe pour constater, pas pour maquiller.
- utiliser l'application pour modifier, falsifier ou masquer un kilométrage, ou pour préparer la revente trompeuse d'un véhicule ;
- intervenir sur un véhicule sans l'accord de son propriétaire ;
- désactiver ou contourner un dispositif de sécurité, de dépollution ou une fonction réglementaire du véhicule ;
- configurer un éclairage non conforme à la réglementation de circulation applicable ;
- contourner les mécanismes d'abonnement, extraire les données protégées de l'application, ou automatiser son usage ;
- utiliser l'application à des fins illégales, ou d'une manière qui porte atteinte à autrui.
11. Suspension et résiliation
Nous pouvons suspendre ou fermer un compte qui enfreint ces conditions, notamment en cas d'usage frauduleux ou de partage d'abonnement.
Vous pouvez cesser d'utiliser l'application à tout moment, résilier votre abonnement depuis votre compte Google ou Apple, et demander la suppression de votre compte.
12. Garanties et limitation de responsabilité
L'application est fournie « en l'état ». Nous ne garantissons ni l'absence d'interruption, ni l'absence d'erreur, ni l'exactitude des informations renvoyées par les calculateurs du véhicule, ni la compatibilité avec un véhicule ou un adaptateur donné.
Dans la limite permise par la loi, notre responsabilité ne peut être engagée pour les dommages indirects, la perte de données, l'immobilisation d'un véhicule, les frais de remorquage ou de réparation, ni pour les amendes ou sanctions résultant d'une configuration non conforme.
Dans la limite permise par la loi, notre responsabilité totale est plafonnée au montant que vous avez versé pour l'application au cours des douze mois précédant le fait générateur.
Rien dans ces conditions n'écarte une responsabilité qui ne peut pas l'être légalement, notamment en cas de faute lourde, de dol ou d'atteinte à l'intégrité physique. Si vous êtes consommateur, vos droits légaux impératifs restent entiers.
13. Votre garantie envers nous
Vous nous garantissez et nous tenez indemnes de toute réclamation, plainte, action, condamnation, amende, frais de défense et honoraires d'avocat émanant d'un tiers ou d'une autorité, dès lors qu'ils découlent :
de votre utilisation de l'application, en particulier des commandes d'écriture que vous exécutez ; d'une intervention sur un véhicule sans l'accord de son propriétaire ; d'une configuration non conforme à la réglementation applicable, notamment en matière d'éclairage et de dépollution ; d'un usage de l'application en circulation ; d'un manquement à ces conditions ou à la loi.
Nous nous réservons le droit d'assurer nous-mêmes la défense de toute réclamation couverte par cette garantie, à vos frais, et vous vous engagez à y coopérer.
Cette clause survit à la fin de votre abonnement et à la suppression de votre compte.
14. Services tiers
L'application s'appuie sur Google Play, ainsi que sur la connexion Google ou Apple. Ces services ont leurs propres conditions et politiques de confidentialité, que vous acceptez en les utilisant. Nous ne répondons pas de leur fonctionnement.
Les adaptateurs de diagnostic sont des produits tiers ; nous n'en sommes ni le fabricant ni le garant.
15. Modifications
Ces conditions peuvent être mises à jour. Toute modification importante sera annoncée dans l'application, et la date d'entrée en vigueur indiquée en tête de page sera mise à jour. Continuer à utiliser l'application après une modification vaut acceptation.
16. Droit applicable
Ces conditions sont régies par le droit algérien. Tout litige relève des tribunaux compétents d'Algérie.
Si vous êtes consommateur et résidez dans l'Union européenne, cette clause ne vous prive pas de la protection des dispositions impératives du droit de votre pays de résidence, ni de la possibilité de saisir les tribunaux de ce pays.

BimmerControl is a diagnostic tool that READS and, with a subscription, WRITES to your vehicle's control units. These terms set out who does what, and who answers for what.
1. Scope and acceptance
These terms govern the use of the BimmerControl app and its related services. By installing or using the app you accept them. If you do not accept them, do not use the app.
2. What the app does
BimmerControl connects to your vehicle's diagnostic socket through an adapter, reads the state of the control units and, depending on your plan, runs commands that the vehicle itself provides.
The app is intended for personal use on a vehicle you own, or on which the owner has authorised you to work.
It is up to you to check that your vehicle and your adapter are compatible, and that what you do is lawful where you are.
3. Safety — read before first use
You alone are responsible for how you use the app, for the commands you run and for their consequences.
- Never use the app while driving. The vehicle must be stationary.
- Some functions physically move parts: headlights, wipers, fans, brake calipers, steering. Make sure nobody is near the vehicle and that no hand is inside a wheel, under the bonnet or in an opening.
- Brake service mode disables the parking brake. Chock the wheels, stay on level ground, and do not move the vehicle while the mode is active.
- Do not use any lighting function — headlight control, light sequence, light show, output test — on a moving vehicle or on a public road. These functions are meant for a stationary vehicle, away from traffic. Dazzling other road users, flashing lights or imitating emergency-vehicle signalling exposes you to criminal penalties and can cause an accident.
- Obey traffic rules and the lighting regulations of your country. A lighting configuration that is allowed somewhere may be illegal elsewhere, and the app does not check that what you set is compliant.
- Insufficient battery voltage during a write operation can damage a control unit. Do not work on a weak battery.
4. Writing to control units
Write functions — actuator tests, adaptations, resets, lighting settings, service modes — genuinely change how the vehicle behaves.
They are only offered where the vehicle declares them itself, and the app asks for confirmation before every write. Even so, it cannot guarantee that a command suits your vehicle in its current condition.
Some operations are irreversible: resetting adaptation values, for instance, erases learning that the control unit will have to redo while driving.
A diagnostic intervention may be recorded and, depending on the case, affect a warranty or a service contract. Check this before writing to a vehicle under warranty.
You take that risk. We do not cover repairs, reprogramming or immobilisation following a write operation.
5. No affiliation with BMW
BimmerControl is an independent app. It is not affiliated with, endorsed, sponsored or supported by BMW AG or any of its subsidiaries.
"BMW", the BMW logo and model designations are registered trademarks of BMW AG, referred to here only to indicate vehicle compatibility.
6. Account
An account is required. It is opened with Google or Apple, and you are responsible for access to it.
An account is personal. Sharing, reselling or pooling it is not permitted.
The information you provide must be accurate.
7. Trial, plans and subscriptions
Prices, durations and trial terms are shown in the app before any payment.
Subscriptions are managed by your Google Play account (or Apple on iOS) and renew automatically unless cancelled at least 24 hours before the end of the current period. Cancellation is done in your Google or Apple subscription settings, not in the app.
When a subscription ends, write functions stop being available. Data already saved on your phone remains yours and remains readable.

8. Refunds
All payments are collected by Google Play or Apple. We do not receive your money directly and therefore cannot refund it ourselves: any request follows the refund policy of the store concerned.
If you live in the European Union, your statutory right of withdrawal for digital content applies under the store's procedures.
9. Intellectual property
The app, its code, its interface, its texts and its graphics belong to BimmerControl and are protected.
You receive a personal, non-exclusive, non-transferable right of use. You may not copy, distribute, rent, sell, modify, decompile or reverse-engineer any part of the app, except to the extent the law allows despite this prohibition.
The diagnostic data specific to your vehicle belongs to you.
10. What you agree not to do
The app reads and displays the mileage figures stored by the various control units. That function exists to establish facts, not to disguise them.
- use the app to alter, falsify or conceal a vehicle's mileage, or to prepare the deceptive resale of a vehicle;
- work on a vehicle without the owner's consent;
- disable or bypass a safety device, an emissions system or a regulatory function of the vehicle;
- configure lighting that does not comply with the applicable road traffic regulations;
- circumvent the subscription mechanisms, extract the app's protected data, or automate its use;
- use the app for unlawful purposes, or in a way that harms others.
11. Suspension and termination
We may suspend or close an account that breaches these terms, in particular in cases of fraudulent use or subscription sharing.
You may stop using the app at any time, cancel your subscription from your Google or Apple account, and request deletion of your account.
12. Warranties and limitation of liability
The app is provided "as is". We do not warrant that it will be uninterrupted or error-free, nor the accuracy of the information returned by the vehicle's control units, nor compatibility with any given vehicle or adapter.
To the extent permitted by law, we are not liable for indirect damage, loss of data, immobilisation of a vehicle, towing or repair costs, or fines and penalties resulting from a non-compliant configuration.
To the extent permitted by law, our total liability is capped at the amount you paid for the app during the twelve months preceding the event giving rise to the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded, in particular for gross negligence, wilful misconduct or personal injury. If you are a consumer, your mandatory statutory rights remain intact.
13. Your indemnity to us
You will indemnify and hold us harmless against any third-party or regulatory claim, complaint, action, penalty, fine, defence cost and legal fee, where it arises from:
your use of the app, in particular the write commands you run; work on a vehicle without its owner's consent; a configuration that does not comply with the applicable regulations, in particular on lighting and emissions; use of the app while in traffic; a breach of these terms or of the law.
We reserve the right to conduct the defence of any claim covered by this indemnity ourselves, at your expense, and you agree to cooperate with it.
This clause survives the end of your subscription and the deletion of your account.
14. Third-party services
The app relies on Google Play, and on Google or Apple sign-in. Those services have their own terms and privacy policies, which you accept by using them. We are not answerable for how they operate.
Diagnostic adapters are third-party products; we are neither their manufacturer nor their guarantor.
15. Changes
These terms may be updated. Any significant change will be announced in the app, and the effective date at the top of this page will be updated. Continuing to use the app after a change means you accept it.
16. Governing law
These terms are governed by Algerian law. Any dispute falls to the competent courts of Algeria.
If you are a consumer resident in the European Union, this clause does not deprive you of the protection of the mandatory provisions of the law of your country of residence, nor of the right to bring proceedings before the courts of that country.

BimmerControl ist ein Diagnosewerkzeug, das die Steuergeräte Ihres Fahrzeugs AUSLIEST und, im Rahmen eines Abonnements, in diese SCHREIBT. Diese Bedingungen legen fest, wer was tut und wer wofür einsteht.
1. Gegenstand und Annahme
Diese Bedingungen regeln die Nutzung der Anwendung BimmerControl und der zugehörigen Dienste. Mit der Installation oder der Nutzung der Anwendung erkennen Sie sie an. Wenn Sie sie nicht akzeptieren, nutzen Sie die Anwendung nicht.
2. Was die Anwendung leistet
BimmerControl verbindet sich über einen Adapter mit der Diagnosebuchse Ihres Fahrzeugs, liest den Zustand der Steuergeräte aus und führt je nach Ihrem Tarif Befehle aus, die das Fahrzeug selbst vorsieht.
Die Anwendung ist für den persönlichen Gebrauch an einem Fahrzeug bestimmt, dessen Eigentümer Sie sind oder an dem der Eigentümer Ihnen Eingriffe gestattet hat.
Es obliegt Ihnen zu prüfen, ob Ihr Fahrzeug und Ihr Adapter kompatibel sind und ob das, was Sie tun, an Ihrem Aufenthaltsort zulässig ist.
3. Sicherheit — vor der ersten Nutzung lesen
Sie sind allein verantwortlich für die Nutzung, die Sie von der Anwendung machen, für die von Ihnen ausgelösten Befehle und für deren Folgen.
- Nutzen Sie die Anwendung niemals während der Fahrt. Das Fahrzeug muss stillstehen.
- Bestimmte Funktionen setzen Bauteile in Bewegung: Scheinwerfer, Scheibenwischer, Lüfter, Bremssättel, Lenkung. Vergewissern Sie sich, dass sich niemand in der Nähe des Fahrzeugs aufhält und dass sich keine Hand in einem Rad, unter der Motorhaube oder in einer Öffnung befindet.
- Der Wartungsmodus der Bremsen setzt die Feststellbremse außer Funktion. Sichern Sie die Räder mit Unterlegkeilen, bleiben Sie auf ebenem Untergrund und bewegen Sie das Fahrzeug nicht, solange dieser Modus aktiv ist.
- Verwenden Sie keine Beleuchtungsfunktion — Scheinwerferansteuerung, Lichtsequenz, Lichtspiel, Stellgliedtest — an einem fahrenden Fahrzeug oder im öffentlichen Straßenverkehr. Diese Funktionen sind für ein stehendes Fahrzeug außerhalb des Verkehrs bestimmt. Das Blenden anderer Verkehrsteilnehmer, das Blinken von Leuchten oder das Nachahmen der Signalgebung eines Einsatzfahrzeugs kann strafrechtliche Sanktionen nach sich ziehen und einen Unfall verursachen.
- Beachten Sie die Verkehrsregeln und die in Ihrem Land geltenden Vorschriften für die Beleuchtung. Eine Lichtkonfiguration, die andernorts zulässig ist, kann hier verboten sein, und die Anwendung prüft nicht, ob das, was Sie einstellen, vorschriftsmäßig ist.
- Eine unzureichende Batteriespannung während eines Schreibvorgangs kann ein Steuergerät beschädigen. Führen Sie bei schwacher Batterie keine Eingriffe durch.
4. Schreibzugriffe auf die Steuergeräte
Die Schreibfunktionen — Aktivierungen, Anpassungen, Rücksetzungen, Beleuchtungseinstellungen, Wartungsmodi — verändern das Verhalten des Fahrzeugs tatsächlich.
Sie werden nur dann angeboten, wenn das Fahrzeug sie selbst ausweist, und die Anwendung verlangt vor jedem Schreibvorgang eine Bestätigung. Gleichwohl kann sie nicht gewährleisten, dass ein Befehl für Ihr Fahrzeug in dessen jeweiligem Zustand geeignet ist.
Bestimmte Vorgänge sind unumkehrbar: Das Zurücksetzen von Anpassungswerten löscht beispielsweise Lernwerte, die das Steuergerät im Fahrbetrieb erneut erlernen muss.
Ein Eingriff über die Diagnose kann von einem Vertragsnetz des Herstellers festgestellt werden und je nach Fall eine Garantie oder einen Servicevertrag beeinträchtigen. Prüfen Sie diesen Punkt, bevor Sie an einem Fahrzeug mit laufender Garantie schreiben.
Sie tragen dieses Risiko. Wir übernehmen weder Reparatur noch Neuprogrammierung noch Ausfallzeiten infolge eines Schreibvorgangs.
5. Keine Verbindung zu BMW
BimmerControl ist eine unabhängige Anwendung. Sie ist weder mit BMW AG oder einer ihrer Tochtergesellschaften verbunden noch von diesen genehmigt, gesponsert oder unterstützt.
„BMW“, das BMW-Logo und die Modellbezeichnungen sind eingetragene Marken der BMW AG und werden hier ausschließlich zur Angabe der Fahrzeugkompatibilität genannt.
6. Konto
Ein Konto ist erforderlich. Es wird über Google oder Apple eröffnet, und Sie sind für den Zugang zu diesem Konto verantwortlich.
Ein Konto ist persönlich. Es weiterzugeben, weiterzuverkaufen oder gemeinschaftlich zu nutzen ist nicht gestattet.
Die von Ihnen angegebenen Informationen müssen zutreffend sein.
7. Testphase, Tarife und Abonnements
Die Preise, die Laufzeiten und die Bedingungen der Testphase werden vor jeder Zahlung in der Anwendung angezeigt.
Die Abonnements werden über Ihr Google Play-Konto (bzw. unter iOS über Apple) verwaltet und verlängern sich automatisch, sofern sie nicht mindestens 24 Stunden vor Ablauf des laufenden Zeitraums gekündigt werden. Die Kündigung erfolgt in den Abonnementeinstellungen Ihres Google- oder Apple-Kontos, nicht in der Anwendung.
Mit Ablauf eines Abonnements stehen die Schreibfunktionen nicht mehr zur Verfügung. Die bereits auf Ihrem Telefon gespeicherten Daten bleiben die Ihren und bleiben lesbar.

8. Erstattungen
Sämtliche Zahlungen werden von Google Play oder von Apple vereinnahmt. Wir erhalten Ihr Geld nicht unmittelbar und können daher nicht selbst erstatten: Jede Anfrage richtet sich nach der Erstattungsrichtlinie des betreffenden Stores.
Wenn Sie in der Europäischen Union ansässig sind, gilt Ihr gesetzliches Widerrufsrecht für digitale Inhalte nach den Modalitäten des jeweiligen Stores.
9. Geistiges Eigentum
Die Anwendung, ihr Code, ihre Benutzeroberfläche, ihre Texte und ihre grafischen Elemente gehören BimmerControl und sind geschützt.
Sie erhalten ein persönliches, nicht ausschließliches und nicht übertragbares Nutzungsrecht. Sie dürfen die Anwendung weder ganz noch teilweise kopieren, verbreiten, vermieten, verkaufen, verändern, dekompilieren oder zurückentwickeln, es sei denn, das Gesetz gestattet dies ungeachtet dieses Verbots.
Die für Ihr Fahrzeug spezifischen Diagnosedaten gehören Ihnen.
10. Wozu Sie sich verpflichten, es zu unterlassen
Die Anwendung liest die in den verschiedenen Steuergeräten gespeicherten Kilometerstände aus und zeigt sie an. Diese Funktion besteht zur Feststellung, nicht zur Verschleierung.
- die Anwendung zu nutzen, um einen Kilometerstand zu verändern, zu verfälschen oder zu verschleiern, oder um den täuschenden Weiterverkauf eines Fahrzeugs vorzubereiten;
- ohne Zustimmung des Eigentümers an einem Fahrzeug einzugreifen;
- eine Sicherheits- oder Abgasreinigungseinrichtung oder eine gesetzlich vorgeschriebene Funktion des Fahrzeugs zu deaktivieren oder zu umgehen;
- eine Beleuchtung einzurichten, die den geltenden Straßenverkehrsvorschriften nicht entspricht;
- die Abonnementmechanismen zu umgehen, die geschützten Daten der Anwendung zu extrahieren oder ihre Nutzung zu automatisieren;
- die Anwendung zu rechtswidrigen Zwecken oder in einer Weise zu nutzen, die Dritte beeinträchtigt.
11. Sperrung und Kündigung
Wir können ein Konto sperren oder schließen, das gegen diese Bedingungen verstößt, insbesondere bei betrügerischer Nutzung oder bei geteilten Abonnements.
Sie können die Nutzung der Anwendung jederzeit einstellen, Ihr Abonnement über Ihr Google- oder Apple-Konto kündigen und die Löschung Ihres Kontos verlangen.
12. Gewährleistung und Haftungsbeschränkung
Die Anwendung wird „wie besehen“ bereitgestellt. Wir gewährleisten weder Unterbrechungsfreiheit noch Fehlerfreiheit noch die Richtigkeit der von den Steuergeräten des Fahrzeugs zurückgegebenen Informationen noch die Kompatibilität mit einem bestimmten Fahrzeug oder einem bestimmten Adapter.
Soweit gesetzlich zulässig, haften wir nicht für mittelbare Schäden, Datenverlust, den Ausfall eines Fahrzeugs, Abschlepp- oder Reparaturkosten sowie nicht für Bußgelder oder Sanktionen infolge einer nicht vorschriftsmäßigen Konfiguration.
Soweit gesetzlich zulässig, ist unsere Gesamthaftung auf den Betrag begrenzt, den Sie in den zwölf Monaten vor dem schadensauslösenden Ereignis für die Anwendung gezahlt haben.
Keine Bestimmung dieser Bedingungen schließt eine Haftung aus, die gesetzlich nicht ausgeschlossen werden kann, insbesondere bei grober Fahrlässigkeit, Arglist oder Verletzung von Leben, Körper und Gesundheit. Sind Sie Verbraucher, bleiben Ihre zwingenden gesetzlichen Rechte unberührt.
13. Ihre Freistellung uns gegenüber
Sie stellen uns von allen Ansprüchen, Beschwerden, Klagen, Verurteilungen, Bußgeldern, Verteidigungskosten und Anwaltshonoraren Dritter oder einer Behörde frei und schadlos, soweit diese beruhen:
auf Ihrer Nutzung der Anwendung, insbesondere auf den von Ihnen ausgeführten Schreibbefehlen; auf einem Eingriff an einem Fahrzeug ohne Zustimmung seines Eigentümers; auf einer Konfiguration, die den geltenden Vorschriften nicht entspricht, namentlich in Bezug auf Beleuchtung und Abgasreinigung; auf einer Nutzung der Anwendung im Straßenverkehr; auf einem Verstoß gegen diese Bedingungen oder gegen das Gesetz.
Wir behalten uns das Recht vor, die Verteidigung gegen jeden von dieser Freistellung erfassten Anspruch auf Ihre Kosten selbst zu übernehmen, und Sie verpflichten sich, daran mitzuwirken.
Diese Klausel gilt über das Ende Ihres Abonnements und die Löschung Ihres Kontos hinaus fort.
14. Dienste Dritter
Die Anwendung stützt sich auf Google Play sowie auf die Anmeldung über Google oder Apple. Diese Dienste haben eigene Bedingungen und Datenschutzerklärungen, die Sie mit ihrer Nutzung akzeptieren. Für deren Funktionsweise stehen wir nicht ein.
Diagnoseadapter sind Produkte Dritter; wir sind weder deren Hersteller noch deren Garantiegeber.
15. Änderungen
Diese Bedingungen können aktualisiert werden. Jede wesentliche Änderung wird in der Anwendung angekündigt, und das oben auf der Seite angegebene Datum des Inkrafttretens wird aktualisiert. Die weitere Nutzung der Anwendung nach einer Änderung gilt als Zustimmung.
16. Anwendbares Recht
Diese Bedingungen unterliegen algerischem Recht. Für alle Streitigkeiten sind die zuständigen Gerichte Algeriens zuständig.
Sind Sie Verbraucher mit Wohnsitz in der Europäischen Union, so entzieht Ihnen diese Klausel weder den Schutz der zwingenden Bestimmungen des Rechts Ihres Wohnsitzstaates noch die Möglichkeit, die Gerichte dieses Staates anzurufen.

BimmerControl, aracınızın kontrol ünitelerini OKUYAN ve abonelik kapsamında bunlara YAZAN bir diyagnostik aracıdır. İşbu koşullar, kimin neyi yaptığını ve kimin neyden sorumlu olduğunu belirler.
1. Konu ve kabul
İşbu koşullar, BimmerControl uygulamasının ve bağlı hizmetlerin kullanımını düzenler. Uygulamayı kurmakla veya kullanmakla bu koşulları kabul etmiş olursunuz. Kabul etmiyorsanız uygulamayı kullanmayın.
2. Uygulamanın işlevi
BimmerControl, bir adaptör aracılığıyla aracınızın diyagnostik soketine bağlanır, kontrol ünitelerinin durumunu okur ve paketinize bağlı olarak, aracın kendisinin öngördüğü komutları yürütür.
Uygulama, sahibi olduğunuz ya da sahibinin müdahale etmenize izin verdiği bir araç üzerinde kişisel kullanım için tasarlanmıştır.
Aracınızın ve adaptörünüzün uyumlu olduğunu ve yaptığınız işlemin bulunduğunuz yerde hukuka uygun olduğunu doğrulamak size düşer.
3. Güvenlik — ilk kullanımdan önce okuyunuz
Uygulamayı kullanma biçiminizden, başlattığınız komutlardan ve bunların sonuçlarından yalnızca siz sorumlusunuz.
- Uygulamayı araç kullanırken asla kullanmayın. Araç durur hâlde olmalıdır.
- Bazı işlevler parçaları hareket ettirir: farlar, silecekler, fanlar, fren kaliperleri, direksiyon. Aracın yakınında kimsenin bulunmadığından ve hiçbir elin bir tekerleğin içinde, kaputun altında ya da bir açıklıkta olmadığından emin olun.
- Fren bakım modu, park frenini işlevsiz hâle getirir. Tekerlekleri takozlayın, düz bir zeminde kalın ve mod etkin olduğu sürece aracı hareket ettirmeyin.
- Hiçbir aydınlatma işlevini — far kumandası, ışık dizisi, ışık gösterisi, çıkış testi — hareket hâlindeki bir araçta veya genel yolda kullanmayın. Bu işlevler, trafiğe kapalı bir yerde durur hâldeki araçlar içindir. Diğer sürücülerin gözünü kamaştırmak, farları yakıp söndürmek veya öncelikli araç sinyalizasyonunu taklit etmek cezai yaptırımlara maruz bırakır ve kazaya yol açabilir.
- Trafik kurallarına ve ülkenizin aydınlatmaya ilişkin mevzuatına uyun. Bir yerde izin verilen bir aydınlatma yapılandırması başka bir yerde yasak olabilir ve uygulama, yaptığınız ayarların mevzuata uygunluğunu denetlemez.
- Bir yazma işlemi sırasında akü geriliminin yetersiz olması, bir kontrol ünitesine zarar verebilir. Zayıf akü ile işlem yapmayın.
4. Kontrol ünitelerine yazma
Yazma işlevleri — aktivasyonlar, adaptasyonlar, sıfırlamalar, aydınlatma ayarları, bakım modları — aracın davranışını gerçekten değiştirir.
Bu işlevler yalnızca aracın kendisi bunları bildirdiğinde sunulur ve uygulama her yazma işleminden önce onay ister. Bununla birlikte uygulama, bir komutun aracınızın o anki durumuna uygun olduğunu yine de garanti edemez.
Bazı işlemler geri alınamaz: örneğin adaptasyon değerlerinin sıfırlanması, kontrol ünitesinin yolda yeniden edinmesi gerekecek bir öğrenmeyi siler.
Diyagnostik yoluyla yapılan bir müdahale, bir üretici ağı tarafından tespit edilebilir ve duruma göre bir garantiyi veya servis sözleşmesini etkileyebilir. Garanti kapsamındaki bir araca yazma işlemi yapmadan önce bu hususu kontrol edin.
Bu riski siz üstlenirsiniz. Bir yazma işleminin ardından ortaya çıkan onarımı, yeniden programlamayı veya aracın kullanılamaz hâle gelmesini üstlenmeyiz.
5. BMW ile herhangi bir bağlantı bulunmaması
BimmerControl bağımsız bir uygulamadır. BMW AG veya iştiraklerinden herhangi biriyle bağlantılı olmadığı gibi, bunlar tarafından onaylanmış, desteklenmiş veya sponsorluk edilmiş de değildir.
„BMW“, BMW logosu ve model adlandırmaları BMW AG'nin tescilli markalarıdır ve burada yalnızca araç uyumluluğunu belirtmek amacıyla anılmaktadır.
6. Hesap
Bir hesap gereklidir. Hesap, Google veya Apple ile açılır ve hesaba erişimden siz sorumlusunuz.
Hesap kişiseldir. Hesabın paylaşılmasına, yeniden satılmasına veya ortak kullanılmasına izin verilmez.
Verdiğiniz bilgiler doğru olmalıdır.
7. Deneme süresi, paketler ve abonelikler
Fiyatlar, süreler ve deneme süresi koşulları, herhangi bir ödeme öncesinde uygulamada gösterilir.
Abonelikler Google Play hesabınız (iOS'ta Apple hesabınız) tarafından yönetilir ve yürürlükteki dönemin bitiminden en az 24 saat önce feshedilmedikçe otomatik olarak yenilenir. Fesih işlemi, uygulamada değil, Google veya Apple hesabınızın abonelik ayarlarından yapılır.
Bir abonelik sona erdiğinde yazma işlevleri kullanılamaz hâle gelir. Telefonunuza daha önce kaydedilmiş veriler size ait olmaya ve okunabilir kalmaya devam eder.

8. İadeler
Tüm ödemeler Google Play veya Apple tarafından tahsil edilir. Paranızı doğrudan almadığımız için iadeyi kendimiz gerçekleştiremeyiz: her talep, ilgili mağazanın iade politikasına tabidir.
Avrupa Birliği'nde ikamet ediyorsanız, dijital içeriklere ilişkin yasal cayma hakkınız, mağazanın usulleri çerçevesinde uygulanır.
9. Fikrî mülkiyet
Uygulama, kodu, arayüzü, metinleri ve grafik unsurları BimmerControl'e aittir ve korunmaktadır.
Size kişisel, münhasır olmayan ve devredilemez bir kullanım hakkı tanınır. Bu yasağa rağmen kanunun izin verdiği ölçü saklı kalmak kaydıyla, uygulamanın tamamını veya bir kısmını kopyalayamaz, dağıtamaz, kiralayamaz, satamaz, değiştiremez, kaynak koda dönüştüremez ve tersine mühendisliğe tabi tutamazsınız.
Aracınıza özgü diyagnostik veriler size aittir.
10. Yapmamayı taahhüt ettikleriniz
Uygulama, farklı kontrol ünitelerinde kayıtlı kilometre değerlerini okur ve gösterir. Bu işlev, durumu tespit etmek için vardır, gizlemek için değil.
- uygulamayı bir kilometre değerini değiştirmek, tahrif etmek veya gizlemek ya da bir aracın yanıltıcı biçimde yeniden satışını hazırlamak için kullanmak;
- bir araca, sahibinin izni olmaksızın müdahale etmek;
- aracın bir güvenlik donanımını, emisyon kontrol sistemini veya mevzuata dayalı bir işlevini devre dışı bırakmak ya da atlatmak;
- yürürlükteki trafik mevzuatına aykırı bir aydınlatma yapılandırmak;
- abonelik mekanizmalarını atlatmak, uygulamanın korunan verilerini çekmek veya kullanımını otomatikleştirmek;
- uygulamayı hukuka aykırı amaçlarla ya da başkalarına zarar verecek biçimde kullanmak.
11. Askıya alma ve fesih
İşbu koşulları ihlal eden bir hesabı, özellikle hileli kullanım veya abonelik paylaşımı hâllerinde askıya alabilir ya da kapatabiliriz.
Uygulamayı kullanmayı dilediğiniz zaman bırakabilir, aboneliğinizi Google veya Apple hesabınızdan feshedebilir ve hesabınızın silinmesini talep edebilirsiniz.
12. Garantiler ve sorumluluğun sınırlandırılması
Uygulama „olduğu gibi“ sunulmaktadır. Kesintisiz olacağını, hatasız olacağını, aracın kontrol üniteleri tarafından döndürülen bilgilerin doğruluğunu ya da belirli bir araç veya adaptörle uyumluluğunu garanti etmiyoruz.
Kanunun izin verdiği ölçüde; dolaylı zararlardan, veri kaybından, bir aracın kullanılamaz hâle gelmesinden, çekici veya onarım masraflarından ya da mevzuata aykırı bir yapılandırmadan doğan para cezaları ve yaptırımlardan sorumlu tutulamayız.
Kanunun izin verdiği ölçüde, toplam sorumluluğumuz, zarara yol açan olaydan önceki on iki ay içinde uygulama için ödemiş olduğunuz tutarla sınırlıdır.
İşbu koşullardaki hiçbir hüküm, hukuken bertaraf edilemeyecek bir sorumluluğu, özellikle ağır kusur, hile veya bedensel bütünlüğe zarar hâllerindeki sorumluluğu ortadan kaldırmaz. Tüketici iseniz, emredici yasal haklarınız tam olarak saklıdır.
13. Bize karşı tazmin yükümlülüğünüz
Aşağıdaki hâllerden doğmaları kaydıyla, bir üçüncü kişiden veya bir idari makamdan gelen her türlü talep, şikâyet, dava, mahkûmiyet, para cezası, savunma gideri ve avukatlık ücreti bakımından bizi tazmin edeceğinizi ve zarardan âri tutacağınızı taahhüt edersiniz:
uygulamayı kullanmanız, özellikle yürüttüğünüz yazma komutları; bir araca sahibinin izni olmaksızın müdahale edilmesi; özellikle aydınlatma ve emisyon konularında yürürlükteki mevzuata aykırı bir yapılandırma; uygulamanın trafikte kullanılması; işbu koşullara veya kanuna aykırılık.
Bu tazmin taahhüdü kapsamındaki her türlü talebin savunmasını, masrafları size ait olmak üzere bizzat üstlenme hakkımızı saklı tutarız; siz de bu savunmaya iş birliği yapmayı taahhüt edersiniz.
İşbu hüküm, aboneliğinizin sona ermesinden ve hesabınızın silinmesinden sonra da yürürlükte kalır.
14. Üçüncü taraf hizmetleri
Uygulama, Google Play ile Google veya Apple oturum açma hizmetlerine dayanmaktadır. Bu hizmetlerin, kullanmakla kabul ettiğiniz kendi koşulları ve gizlilik politikaları vardır. Bunların işleyişinden sorumlu değiliz.
Diyagnostik adaptörleri üçüncü taraf ürünleridir; bunların ne üreticisi ne de garantörüyüz.
15. Değişiklikler
İşbu koşullar güncellenebilir. Önemli her değişiklik uygulama içinde duyurulacak ve sayfanın başında belirtilen yürürlük tarihi güncellenecektir. Bir değişikliğin ardından uygulamayı kullanmaya devam etmeniz, değişikliği kabul ettiğiniz anlamına gelir.
16. Uygulanacak hukuk
İşbu koşullar Cezayir hukukuna tabidir. Her türlü uyuşmazlık, Cezayir'in yetkili mahkemelerinin görev alanına girer.
Tüketici iseniz ve Avrupa Birliği'nde ikamet ediyorsanız, işbu hüküm sizi ikamet ettiğiniz ülke hukukunun emredici hükümlerinin sağladığı korumadan ya da o ülkenin mahkemelerine başvurma imkânından yoksun bırakmaz.
